1. Introduction and Scope

1.1 About This Platform

This assessment platform is operated by Trading Interview B.V. (“we”, “us”, “our”) and is used by companies (“Client Companies”) to assess candidates (“you”, “Candidate”) for employment opportunities.

1.2 How You Access This Platform

Access to this platform is by invitation only. You have been invited by a Client Company to complete an assessment as part of their recruitment process. You cannot purchase or subscribe to this service independently.

1.3 Three-Party Relationship

By using this platform, you acknowledge that:

  • The Client Company has contracted us to provide assessment services
  • Your assessment results will be shared with the Client Company
  • We act as a data processor on behalf of the Client Company

2. Data Collection and Processing

2.1 What Data We Collect

2.2 Legal Basis for Processing

We process your data based on:

  • Legitimate Interests: The Client Company’s legitimate interest in assessing candidates for employment
  • Consent: Your explicit consent given by starting the assessment
  • Legal Obligations: Where required by employment or anti-discrimination laws

3. Use and Sharing of Your Data

3.1 How We Use Your Data

  • Administering and scoring your assessment
  • Generating reports for the Client Company
  • Ensuring assessment integrity and preventing fraud
  • Improving our assessment tools (using anonymized data)
  • Complying with legal obligations

3.2 Who We Share Your Data With

Important: Your assessment results and related data WILL be shared with the Client Company that invited you. This is the primary purpose of the assessment.

We may also share your data with:

  • Service Providers: Our hosting provider (onRocket.com LLC, USA) under Standard Contractual Clauses
  • Legal Authorities: When required by law or court order
  • Never: We do NOT sell your data to third parties

4. Your Rights Under GDPR

4.1 Your Data Protection Rights

As an EU resident, you have the right to:

  • Access: Request a copy of your assessment data
  • Rectification: Correct inaccurate personal information
  • Erasure: Request deletion (subject to Client Company’s retention requirements)
  • Restriction: Limit processing of your data
  • Portability: Receive your data in a machine-readable format
  • Object: Object to certain processing activities
  • Withdraw Consent: Withdraw consent at any time (this may end your assessment)

4.2 How to Exercise Your Rights

To exercise these rights:

  1. Contact us at: assessments@tradinginterview.com
  2. We will coordinate with the Client Company as needed
  3. We will respond within 30 days
Note: Some requests may need to be directed to the Client Company as the data controller. We will inform you if this is the case.

5. Data Retention

Your assessment data is retained as follows:

  • Assessment Results: 24 months from assessment date, then anonymized
  • Technical Logs: 90 days
  • Client Company: May have different retention periods based on their policies and legal requirements

6. Assessment Rules and Integrity

6.1 Your Obligations

During the assessment, you must:

  • Complete the assessment yourself without assistance
  • Not use unauthorized materials or resources unless specified
  • Not share assessment content with others
  • Not attempt to manipulate or cheat the system
  • Complete the assessment in one session unless otherwise specified

6.2 Monitoring and Detection

Warning: We use various technologies to ensure assessment integrity, including:
  • Browser activity monitoring
  • Pattern analysis
  • Time tracking
  • Copy/paste detection
Violations may be reported to the Client Company and may affect your application.

7. Technical Requirements and Security

7.1 Your Responsibilities

  • Ensure stable internet connection
  • Use a supported browser (Chrome, Firefox, Safari, Edge)
  • Complete the assessment in a suitable environment
  • Report technical issues immediately

7.2 Our Security Measures

We protect your data using:

  • Encryption in transit (TLS 1.3) and at rest (AES-256)
  • Secure data centers with restricted access
  • Regular security audits
  • Limited access on a need-to-know basis

8. International Data Transfers

Your data may be transferred to and processed in the United States by our hosting provider. We ensure adequate protection through:

  • Standard Contractual Clauses approved by the European Commission
  • Technical and organizational security measures
  • Contractual obligations for data protection
  • Servers based in The Netherlands only

9. Cookies and Tracking

We use essential cookies and similar technologies to:

  • Maintain your assessment session
  • Ensure platform security
  • Prevent fraud and cheating
  • Remember your progress if allowed to pause

These are strictly necessary cookies required for the assessment to function.

10. Disclaimers and Limitations

10.1 No Guarantee of Outcome

We provide assessment services only. We do not:

  • Make hiring decisions
  • Guarantee employment outcomes
  • Represent the Client Company

10.2 Limitation of Liability

To the maximum extent permitted by law, Trading Interview B.V. is not liable for:

  • Client Company’s use of assessment results
  • Employment decisions made by the Client Company
  • Technical issues beyond our reasonable control

11. Complaints and Disputes

11.1 Complaints Process

  1. First, contact us at assessments@tradinginterview.com
  2. If unresolved, contact the Client Company
  3. You may lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens)

11.2 Governing Law

These terms are governed by Dutch law. Any disputes shall be submitted to the competent courts of Rotterdam, Netherlands.

12. Changes to These Terms

We may update these terms occasionally. If we make material changes:

  • We will update the “Effective Date”
  • We will notify Client Companies
  • You will be asked to consent to new terms before future assessments
